Thank you for using the VMC.ai (the “Website”). VMC.ai B.V. ("us", "we", or "our") cares deeply about the privacy of everyone that visits our website (the “Users”). Being a Dutch incorporated limited liability company (Besloten Vennootschap), we fully comply with the EU’s General Data Protection Regulation. Please note that by using our website, sign-up form and account registration system (together, the “Registration System”), you agree to be bound by this Privacy Policy, as well as our Cookie Policy . If you do not agree with our privacy policy, please do not use our website and Registration System. We process two kinds of data: User data and User-Submitted data. User data is information about your usage of our website, which we collect with cookies. User-submitted data is comprised of any information that you fill in when using our Registration System. Below, you will find all relevant information about the data we collect about our visitors, why we collect this data and how we use it. We also explain who has access to your personal data, how we make sure your personal data will never fall into the wrong hands and what your rights are with regards to your data.

User Data

What data do you collect?

When you visit VMC.ai, we process data regarding your usage of the website and your interaction with its pages. We also record ‘referral data’, which is information about how you came to our website. Lastly, we also process information about the device you use to access our website and your location and IP address. This ‘User Data’ is not tied to you as a person and VMC.ai does not know or trace any identities connected to the data. You can find out more about our collection of User Data in our Cookie Policy .

Why do you process this data?

We process User Data to analyze how people use our website in order to optimize the User’s experience, improve our marketing and understand our users. The first time you visit our website, you are informed about our use of cookies. You are also given the opportunity to provide your consent to the processing of your User Data. When you use the Registration system, you will be prompted to give your consent for the processing of User Data at the point of submitting the registration form or creating an account. As such, the legal bases for processing User Data are our legitimate business interests, as well as your consent.

Do you share this data with third parties?

First of all, we will never sell your data to anyone. However, there are third parties which store User Data for us, thereby acting as our third-party ‘Data Processors’. These parties are Google (for Google Analytics data) and Typeform (for User Data as relating to the Typeform we use for User registration). Typeform A.G. in turn uses Amazon’s Web Services to store the User Data. These companies acts as our Data Processors.

For how long do you store this data?

We store User Data for a period of 26 months since your last visit, or 26 months since the moment of registration. After this period, the User Data will be automatically deleted.

How do you secure this data?

Since the User Data we collect is stored on Amazon’s Web Services and Google’s data storage facilities, you can be sure that your data is completely secure. These companies have implemented state of the art data-security mechanisms and processes, as reflected, for example, by their ISO 27001 Certifications.

User-submitted Data

What data do you collect?

We use a Typeform that allows Users to indicate their interest in our private sale to VMC.ai. For our public sale, we might make use of a more advanced ‘whitelisting’ registration system, which can be used to create an account on our website. Both systems may ask you, the User, to fill in personal information, including your name, date of birth, nationality, country of residence and contact details, such as your email address, phone number or telegram username.

Why do you process this data?

We process User-Submitted Data to be able to identify you, perform so-called ‘Know-You-Customer’ checks, to determine if you are eligible to invest in our security token sale and to contact you. As such, the legal bases for processing User-Submitted Data are our legitimate business interests, compliance with our legal obligations and your consent.

Do you share this data with third parties?

First of all, we will never sell your data to anyone. We also don’t share User-Submitted Data with anyone, except where required by law. The information you fill in when using our Registration System is processed by Typeform A.G., who, in turn, uses Amazon Web Services to store the data. These companies act as our Data Processors.

For how long do you store this data?

We will store User-Submitted Data for no longer than 6 months after the second phase of your public sale. After this period, we will delete all User-Submitted Data.

How do you secure this data?

Since the User Data we collect is stored on Amazon’s Web Services, you can be sure that your data is completely secure. Amazon Web Services has implemented state of the art data-security mechanisms and processes, as reflected by their ISO 27001 Certifications.

Cross-Border Data Transfer and Automated Processing

Please be aware that your personal data is stored ‘in the cloud’ by international companies such as Google and Amazon. As such, your personal data may be transferred to, processed, and stored in third-party countries, both within and outside of the European Economic Area and in the United States. Any such transfers will only occur to countries whose legal regime is deemed to provide for an ‘adequate’ level of personal data protection by the European Commission, with the appropriate safeguards and certifications in place. You consent to the transfer of your information, including personal information, to third party countries, including the United States, as set forth in this Privacy Policy, by visiting our site and using the Registration System. We do not use any kind of Automated Processing or automated profiling with regards to your personal data.

Your Rights

Under the General Data Protection Regulation, you have a number of rights regarding your personal information. These rights are listed below. You can submit any requests concerning your data rights under the GDPR by email to [email protected]. We may, in turn, request you to provide us with specific information to help us confirm your identity and process your request. We may also decline (parts of) your request, where permitted by applicable law. If so, we will inform you as to the reasons behind our decision to do so.

Right to Opt-out

You have the right to opt-out of any communications we send you. Therefore, in the emails we send out, we will include a link to a page that allows you to opt-out of future communications via our mailing list.

Right of Access

You have the right to request us to further inform you about the purposes of the data processing, the categories or personal data we have about you, with which parties this data is shared, for how long the data is stored, whether we use any automated decision-making and how you can lodge a complaint with the applicable supervisory authority (the Dutch Data Protection Authority). You can also ask us to provide you with an overview of your personal data that we have stored.

Right to Rectification

You have the right to request us to update your personal information or correct any inaccuracies in terms of your personal data.

Right to Erasure

You have the right to request us to delete any personal information we have about you.

Right to Data Portability

You have the right to request us to transfer a machine-readable copy of your personal information to you or a third-party of your choice.

Right to Object

You have the right to object to our reliance on legitimate interests as the basis of our processing of your personal information if you feel that this processing unproportionally impacts your rights.

Changes to this Privacy Policy

We may change this privacy policy at any time. As such, we encourage you to periodically review this page for the latest information regarding our policies. Any modifications to this Privacy Policy will be effective immediately on publishing. In all cases, your continued use of our website after the posting of any modified Privacy Policy indicates your acceptance to the terms of the policy.
